Commitment to Civil Rights, Justice, and Equality

Last year, JWC took on a case against the Alameda County Sheriff’s Department on behalf of an 80-year-old deaf woman who suffered injuries after a violent arrest—for allegedly crossing against a traffic signal.  Although we are pleased with the result we obtained for our client, we are—and have been—deeply distressed that incidents of excessive force continue to occur.  This case was not the first (or second or third) time we have used our skills as lawyers to hold law enforcement accountable for their actions, including on pro bono basis.  

We must all take responsibility and do our part to advance civil rights and fight injustice and inequality. And we strongly urge everyone who is in a position to effectuate positive change, particularly by advancing voices through our legal system, to also take action.

Candyman Files Lawsuit Against Sweets Indeed

On January 27, 2020, JWC clients Candyman Kitchens and Can You Imagine That! Confections filed a Complaint against Sweets Indeed in the Central District of California. The lawsuit involves allegations of trademark infringement by Sweets Indeed and counterfeit products.

The case is: Candyman Kitchens Inc. and Can You Imagine That! Confections Inc., No. 2:20-cv-841, U.S. District Court, Central District of California (C.D. Cal.)


Jin v. Alameda County Reaches Settlement Favorable to JWC Legal’s Client

On January 3, 2020, the case involving JWC’s client Hui Jie Jin and the Alameda County Sheriff’s Office was concluded. The parties have agreed to settle the dispute for $318,000, payable to JWC’s client Jin. The court concluded the case on the condition that Defendants deliver the settlement amount to Jin within 90 days.

The case is: Hui Jie Jin v. Alameda County, et al., No. 3:18-cv-04885, U.S. District Court, Northern District of California (N.D. Cal.)

JWC Represents Deaf Woman Against Alameda County

 

On October 28, 2019, attorneys from JWC entered appearances to represent a deaf woman in a Federal lawsuit against Alameda County Sheriff’s Office and other defendants. Stay tuned for updates regarding the resolution of this dispute!

Proofpoint and Cloudmark File Lawsuit Against Vade Secure

On July 23, 2019, JWC clients Proofpoint, Inc. and Cloudmark LLC filed a Complaint in the Northern District of California against Vade Secure, et al. The Complaint alleges the defendants misappropriated Proofpoint and Cloudmark’s cyber security trade secrets, as well as breached key non-disclosure and employment agreements.

The case is: Proofpoint, Inc. and Cloudmark LLC v. Vade Secure, Inc., et al., No. 3:19-cv-4238, U.S. District Court, Northern District of California (N.D. Cal.)


Apple and Qualcomm Agree to Global Settlement of Litigation

In April 2019, JWC client Qualcomm and Apple agreed to settle ongoing litigation. According to The Verge, “Qualcomm ha[d] managed to put pressure on Apple. It managed to win iPhone bans in Germany and China over patent violations, and it won a lawsuit in the US that put a high price on just a small number of its patents. More wins for Qualcomm could have ended up raising the price for Apple, which may have made the company more inclined to settle.”


Jury Awards Qualcomm $31 Million

On March 15, 2019, a jury in Federal Court returned a verdict determining that Apple infringed three patents held by JWC client Qualcomm, and should pay client Qualcomm $31 Million.

The case is: Qualcomm Inc. v. Apple Inc., No. 3:17-cv-1375, U.S. District Court, Southern District of California (S.D. Cal.)


Apple Found to Infringe Qualcomm Patent

On March 26, 2019, ALJ MaryJoan McNamara of the U.S. International Trade Commission found that Apple infringed JWC client Qualcomm’s U.S. Patent No. 8.063,674. ALJ McNamara’s decision indicates that she will recommend that Apple’s infringing products be banned from importation into the United States.

The investigation is: In the Matter of Certain Mobile Electronic Devices and Radio Frequency and Processing Components Thereof (II), Inv. No. 337-TA-1093 (U.S.I.T.C.)


Creative Technology Unit Settles Patent Infringement Claims Against NVIDIA

On February 9, 2019, Creative Technology Business Unit, ZiiLabs, agreed to settle patent Infringement lawsuits against JWC client NVIDIA and other defendants. The settlement came as the parties were preparing for a hearing before the U.S. International Trade Commission.

The investigation is: In the Matter of Certain Graphics Processors and Products Containing the Same, Inv. No. 337-TA-1099 (U.S.I.T.C.)


Court Allows Qualcomm to Pursue Trade Secret Claims Against Apple in $5B Case

On October 25, 2018, San Diego Superior Court Judge Jacqueline Stern granted a motion brought by JWC client Qualcomm to amend its Complaint to include new allegations that Apple misappropriated over 30 of Qualcomm’s technical trade secrets relating to cellular baseband technology. Qualcomm expects to seek $5 billion in damages.

The case is: Qualcomm Inc. and Qualcomm Technologies, Inc. v. Apple Inc., et al., No. 37-2017-00041389, Superior Court of California
